I have a flat in Arekere Bangalore area and the 2 BHK flat has the following w.r.t documentations: 1. Sale deed is available 2. Property tax is paid since last several years 3. Electricity and water connection is available 4. OC and CC and hence khata is NOT available. So given the documents available, is the re-sale of the flat possible??

From what I understand, this is a tricky situation. Sale Deed should have your name registered as the owner of the property. It is a one document which is a legal proof of your ownership of the house and is important for buying and selling of properties. However, Khata is an important document which entitles you as the legal owner of the property. Even though the property may be registered, without an OC, you can't get a Khata. Builder needs a CC from the local authorities which mentions that the flat or the building has been constructed as per the approved plan and hence is legal. Thereafter, the builder can apply for an OC, which will be a proof of occupancy at the time of selling of flat. Hence without CC and OC, resale of flat will be tough, it may reduce the value of your flat also. A-Khata is given if there is an OC. You can apply for B-Khata since you don't have an OC. In some areas of Bangalore e-Khata (electronic-khata) is given. This is also acceptable for resale. If your flat is in a society or a building, all the flat owners should bifurcate and apply for Khata together.
