We have recently bought a plot in Delhi and we want to construct a building on it. So, we talked to a builder to know the permissible height of building in Delhi. He explained everything clearly to us.

He told us that the building height is the building’s maximum vertical height measured from the highest structure on the roof to the plinth level at the main entrance. The height of roof equipment, chimneys, parapet walls, and vents is eliminated from the building’s total height.

With a maximum height of 15 metres, the total number of floors that one can construct is Four + Stilt.

The rules of construction were different in 2007, and in 2021 they were again revised. So the 5th floor allowed in Delhi 2041 is unclear as of now. DDA has sent the plan for approval to the central authorities and a word is expected to be out soon on the same. The rules might change in the near future. But as per my understanding, yes, the 5th floor can be constructed in Delhi. I have researched the residential rules thoroughly in Delhi since I am also a resident of this city, so let me share with you all the updated norms.

How many floors are allowed in Delhi?

Delhi has not clearly stated how many floors are allowed, but the rules do mention the height of the building. Based on that height, you can find out whether the 5th floor is allowed or not. The MCD rules for construction of 5th floor were different in 2007. Until 2007, the height of a residential building was limited to 15m only. So 15 m means 4th floor, but yes, if you make your ceiling height low, you can go for the 5th floor with an overall height of 15m for the building. 

The 5th floor allowed in Delhi since 2021. The height got increased to 17.5 m but only if the building has stilt parking. I hope the confusion is clear. I have seen many people pose the question- "Is 5th floor allowed in Delhi 2023?" I would like to say yes, it is allowed if your building has only stilt parking. If it does not have that kind of parking, you will not be allowed to construct the 5th floor.

So I cannot say whether 5th floor allowed in Delhi 2041 or not but in 2023 it is allowed.

the maximum number of floors that can be constructed in Delhi is four plus a stilt, which equals five floors.

Recently, the Unified Building Bye-Laws 2023 (UBBL 2023), notified by the MCD on March 31, 2023 superseded the old Delhi Building Bye-Laws 2016. The old building bye laws in Delhi allowed for a maximum of four floors without a stilt.

How Many Floors Allowed in Delhi?

I will share with you a breakdown of the maximum number of floors allowed in different areas of Delhi under the UBBL 2023:

  • Residential areas: Four floors plus a stilt

  • Commercial areas: Five floors plus a stilt

While renovating my house during the summer this year, I came to know that MCD has approved new regulations pertaining to the construction of residential buildings, allowing Delhi residents to add a floor to their structure.

My house was a 4-floor building and I wanted to add one more floor. I learnt at that time that the MCD has decided to construct five floors of buildings with plots under the new regulation being prepared for the Delhi Master Plan 2041 so that the people of Delhi will be able to increase a floor in the building. The Delhi City Company recently authorised new regulations regarding the construction of residential buildings in the capital.

I also read that the Confederation of All India Traders (CAT) granted Delhi permission to add a floor to the residence building. The National Secretary of State for CATs, stated that the residential buildings, which were still only 15 metres tall, needed to be raised in order to keep up with the population growth in Delhi.

  • Any building, which is above this height would need approval and NOC from the fire department.
