See, when you are in a legally binding contract, you cannot break it. In that case the landlord has all the rights to keep the deposit with himself/herself. This is because he will not be receiving the rent from you for the said time period. Yet you say that the previous tenant is living there, you can reason with the broker or landlord and explain your reasons for calling off the contract.If you are someone with scenario 2, there is nothing much that you can do than to convince them politely.
